Understanding the Nikah Contract: Rights and Duties

What the nikah contract actually is

The nikah is a solemn contract of marriage under Islamic law, registered in Pakistan under the Muslim Family Laws Ordinance. It requires the offer (ijab) and acceptance (qabool), two adult Muslim witnesses, and clear consent from both parties. The nikahnama documents these elements and adds terms both sides have agreed to, which become binding.

Key clauses to read carefully

Mahr — prompt and deferred

Clauses covering mahr specify the amount, whether it is prompt (paid at nikah) or deferred (paid later), and its form (cash, gold, property). Do not leave this vague. A reasonable prompt portion should ideally be paid immediately, with the deferred amount realistic and documented.

Right of divorce delegated to the wife (talaq-e-tafweez)

Clause 18 of the standard nikahnama asks whether the husband has delegated the right of talaq to the wife. This does not mean divorce becomes easier — it means the wife can initiate divorce without going through lengthy court procedures if serious circumstances arise. Many families cross this out out of misunderstanding. Discuss it openly and make an informed choice, not a reflexive one.

Special conditions

Clauses 17 and 20 allow additional agreed conditions — for example, that the husband will not marry a second wife without the first wife's consent, or that the wife may continue her career, or that certain financial arrangements will apply. These are legally enforceable if written in. Discuss what conditions matter to your marriage before nikah, not after.

Rights the nikah gives the wife

  • Right to mahr in full, as her own property.
  • Right to maintenance (nafqah) — food, clothing, shelter appropriate to the husband's means.
  • Right to dignified treatment and freedom from abuse.
  • Right to visit and maintain contact with her family.
  • Right to intimacy and companionship.
  • Right to consent — she cannot be forced into marriage, and any nikah without her genuine consent is invalid.

Section 05

Rights the nikah gives the husband

  • Right to companionship, intimacy, and cooperation in building the home.
  • Right to be respected as the qawwam of the household.
  • Right to be informed and consulted on family decisions.
  • Right to peaceful, respectful conduct from his wife.

Section 06

Duties that fall on both

Both spouses are obligated to treat each other with kindness, to be faithful, to preserve each other's honour, to raise any children in Islam, and to fear Allah in how they treat each other. The Qur'an calls spouses 'garments' for each other — a beautiful image of mutual protection, warmth, and closeness.

Section 07

What if something goes wrong later

A well-drafted nikahnama protects both spouses if the marriage runs into trouble. Documented mahr, delegated talaq clauses, and any special conditions become the reference point for family, mediators, and if needed, courts. This is not planning for failure; it is honouring the seriousness of what you are signing.
